TERMS & CONDITIONS

The Katiya Experience LLC, d/b/a The Katiya Experience (“The Katiya Experience,” “we,” “us,” “our”), a Florida limited liability company, is a full-service travel agency offering personalized travel services for our clients (“you,” “traveler,” “guest,” or “participant”).  With a commitment to personalized itinerary creation, group travel coordination, and curated experiences, we specialize in transforming travel dreams into unforgettable experiences. 

CONTRACT. These Terms and Conditions govern your access to and use of our website, your purchase or use of our Services, and all bookings made through The Katiya Experience. These Terms and Conditions, together with any applicable booking confirmation, retreat participation agreement, service agreement, invoices, itineraries, policies, written communications, and the terms and conditions of our third-party suppliers, constitute the entire agreement between you and The Katiya Experience with respect to the applicable Services (collectively, the "Terms and Conditions").

Before making a booking or using our Services, you should carefully review these Terms and Conditions and contact us with any questions.


PLEASE BE ADVISED THAT THESE TERMS AND CONDITIONS CONTAIN IMPORTANT LIMITATIONS OF LIABILITY, DISCLAIMERS, WAIVERS OF CERTAIN LEGAL RIGHTS, A WAIVER OF CLASS ACTION, AND PROVISIONS GOVERNING VENUE AND DISPUTE RESOLUTION.


By accessing our website, requesting our Services, making a booking, purchasing a retreat or other travel service, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.


If you are making a booking on behalf of another individual, family, couple, business, or group, you represent that you are authorized to accept these Terms and Conditions on behalf of each traveler included in the booking. You agree to provide each traveler with a copy of these Terms and Conditions, and you remain financially responsible for the booking. We shall not be liable for your failure to provide these Terms and Conditions to any traveler included in your booking.


You represent and warrant that: (a) you are at least eighteen (18) years of age or otherwise have the legal capacity to enter into binding contracts; (b) you have the legal authority to enter into this agreement on your own behalf and, where applicable, on behalf of any other traveler included in your booking; (c) all information you provide to us is accurate, complete, and current; and (d) you will use our website and Services only for lawful purposes and in accordance with these Terms and Conditions.

VIOLATIONS BY YOU. You agree that any violation of these Terms and Conditions may result in, without limitation: (a) the cancellation of your reservation or purchase; (b) the forfeiture of any monies paid, subject to any applicable supplier terms or retreat participation agreement; (c) your being denied access to the applicable travel-related product or service; and (d) the suspension or termination of your access to our website or Services.

CHANGES TO THESE TERMS AND CONDITIONS. The Katiya Experience reserves the right, in our sole discretion, to modify these Terms and Conditions at any time. If we make material changes that apply to an existing booking or retreat reservation, we will provide notice as required by applicable law or as otherwise reasonably practicable. Please review these Terms and Conditions periodically, particularly before making a booking or purchasing any Services. Your continued use of our website or Services, including maintaining or using any booking or reservation after any changes become effective, constitutes your acceptance of the revised Terms and Conditions.

BOOKING/PAYMENT. When you are ready to start planning your next travel adventure, you may contact us by phone or by email at katiya@thekatiyacollective.com. Together, we will discuss your travel needs, how we work, and whether our Services are a good fit for your trip. We will present you with a custom quote and/or itinerary, together with the applicable deposit requirements, final payment dates, and cancellation policies of the applicable supplier. You will also provide payment information and the personal travel information necessary to complete your booking.


Certain Services, including retreats organized and hosted by The Katiya Experience, may be subject to separate agreements, booking confirmations, cancellation policies, payment schedules, or other supplemental documents. Where applicable, those additional documents supplement these Terms and Conditions and shall govern the specific Service being purchased in the event of a conflict.


Please note that most bookings require a deposit at the time of booking in accordance with the applicable supplier's booking policy. If a booking is made within the supplier's final payment window, full payment is due at the time of booking. Any changes requested after receipt of the final itinerary may result in additional fees, including change fees imposed by the applicable supplier. Deposits are typically NON-REFUNDABLE, unless otherwise stated in the applicable supplier's terms and conditions or, for retreats organized by The Katiya Experience, the applicable Retreat Participation Agreement or booking confirmation. Pricing and availability are dynamic and are subject to change until the required deposit has been received.


Please review the applicable supplier's payment deadlines, cancellation policies, and terms and conditions carefully. You are responsible for making all required payments in full and on time. If full payment is not received by the due date reflected on your invoice or booking confirmation, we reserve the right to cancel your booking or reservation and apply any applicable cancellation charges. Failure to make timely payment may result in cancellation of your booking, which shall be treated as a cancellation initiated by you and subject to the applicable cancellation terms and fees. You acknowledge that discounted fares, promotional pricing, and special offers frequently carry restrictions and that changes to any travel arrangements may result in additional charges.


By submitting payment information or authorizing us to process payment on your behalf, you represent and warrant that you are authorized to use the applicable payment method and authorize us and/or the applicable supplier to charge all amounts due in connection with your booking.


Where applicable, approximately two weeks prior to your departure, we will provide your itinerary containing a summary of your travel confirmations, confirmed pricing, and destination information. Certain suppliers may provide additional information, including on-site contacts or updated travel information, closer to your departure date. If so, we will provide those updates as they become available.


Please promptly review all itineraries, booking confirmations, Welcome Kits (if applicable), travel documents, supplier confirmations, cancellation policies, and supplier terms and conditions. It is your responsibility to notify us within twenty-four (24) hours of receiving any travel documentation if you identify any errors or discrepancies. We are not responsible for errors that are not timely reported.

PLANNING FEE. Although our work on your travel experience begins when you engage us, the planning process begins long before that. We dedicate significant time to travel advisor education, supplier relationship development, destination research, and ongoing industry networking in order to provide our clients with personalized travel recommendations and curated experiences. Preparing proposals often requires substantial planning, research, and communication with Suppliers to develop customized travel itineraries.


To compensate for our experience, time, and effort, we may charge a non-refundable planning fee. Planning fees vary depending on the type of booking, destination(s), length of travel, number of travelers, complexity of the itinerary, and the extent of planning involved. Following our initial discovery call, if a planning fee applies, we will provide an invoice for immediate payment.


Unless otherwise agreed in writing, planning fees must be paid in full before we begin preparing proposals, itineraries, or recommendations. Planning fees compensate us for professional services rendered and are non-refundable regardless of whether you ultimately purchase or book any travel Services through us.

SCOPE OF SERVICES; THIRD-PARTY SUPPLIERS. Except with respect to retreats that are organized and hosted directly by The Katiya Experience, The Katiya Experience does not own, manage, operate, supervise, control, or provide the travel services and products that comprise your travel arrangements, including, without limitation, flights, accommodations, cruises, tours, excursions, rental vehicles, vacation packages, or travel insurance (collectively, the "Travel Products"). Such Travel Products are provided by independent third-party suppliers, including destination management companies, airlines, hotels, cruise lines, tour operators, transportation providers, and other travel suppliers (collectively, the "Suppliers").


For retreats organized and hosted by The Katiya Experience, we act as the organizer and coordinator of the retreat experience. However, the accommodations, transportation, excursions, activities, restaurants, and other travel-related services associated with the retreat are provided by independent Suppliers operating under their own terms and conditions.


Suppliers are solely responsible for the Travel Products and any associated services, amenities, promotions, credits, or benefits they provide. All bookings remain subject to the applicable Supplier's terms and conditions and privacy policies. By making a booking through us, you acknowledge that you have reviewed and agree to be bound by the applicable Supplier's terms and conditions.


Your interactions with any Supplier are at your own risk. To the fullest extent permitted by applicable law, The Katiya Experience shall not be responsible or liable for any act, error, omission, injury, illness, death, property damage, loss, delay, cancellation, overbooking, bankruptcy, insolvency, negligence, willful misconduct, or other act or omission of any Supplier or its officers, directors, employees, contractors, agents, representatives, or affiliates.


TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE KATIYA EXPERIENCE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO ANY TRAVEL PRODUCTS OR SERVICES PROVIDED BY A SUPPLIER, REGARDLESS OF THE THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

AIR RESERVATIONS. Your contract for air transportation is solely with the applicable air carrier and is subject to that carrier's terms and conditions. The Katiya Experience is not responsible for schedule changes, flight delays, cancellations, denied boarding, baggage issues, seat assignments, fare rules, change fees, cancellation fees, or any other charges imposed by an air carrier.


If you request that The Katiya Experience arrange airfare on your behalf, you acknowledge that certain airlines may require all ticket modifications, cancellations, or other servicing requests to be processed through the original booking source rather than directly with the airline. You agree that we are not responsible for any limitations imposed by the airline regarding changes or access to your reservation.

TRAVELER INFORMATION. The names provided for all reservations must exactly match each traveler's government-issued identification and passport, where applicable. You are solely responsible for providing accurate names, dates of birth, passport information, and any other information required to complete your booking.


Any errors or omissions in traveler information may result in Supplier-imposed fees, cancellation of reservations, denied boarding, denied entry into a destination, or the purchase of new travel arrangements. Not all name corrections are permitted by Suppliers, and certain corrections may require the purchase of a new ticket or reservation.


You are responsible for carefully reviewing all booking confirmations, itineraries, travel documents, and other materials provided by The Katiya Experience and notifying us of any discrepancies within twenty-four (24) hours of receipt. To the fullest extent permitted by applicable law, The Katiya Experience shall not be responsible for any costs, losses, delays, or other consequences resulting from inaccurate or incomplete traveler information provided by you or your failure to timely identify and report errors.

CREDIT CARD BOOKINGS. While most Suppliers accept major credit cards, including Visa, Mastercard, American Express, and Discover, you authorize The Katiya Experience to process payments using the payment method you provide or otherwise authorize for your booking. By providing payment information or authorizing a transaction, you represent and warrant that you are authorized to use the applicable payment method and agree to these Terms and Conditions, including all applicable cancellation policies and payment obligations.


In certain circumstances, you may have the ability to dispute charges with your credit card issuer ("chargebacks"). Before initiating a chargeback, we ask that you first contact us to discuss any questions or concerns regarding your booking or any charges. We will make reasonable efforts to resolve your concerns.


You agree not to initiate or encourage any chargeback or payment dispute for any payment that was properly authorized or is otherwise due under these Terms and Conditions or any applicable booking agreement. The Katiya Experience reserves the right to dispute any improper chargeback and to recover all resulting losses, including, without limitation, bank fees, payment processor fees, collection costs, and reasonable attorneys' fees to the extent permitted by applicable law. We also reserve the right to cancel any pending or future bookings associated with an improper chargeback.


Examples of improper chargebacks include, without limitation:

  • Chargebacks relating to non-refundable reservations or deposits. 

  • Chargebacks for reservations authorized by you or by any individual to whom you voluntarily provided access to your payment method, excluding unauthorized or fraudulent transactions. 

  • Chargebacks arising from dissatisfaction with a Supplier's services, accommodations, products, or experiences. 

  • Chargebacks arising from Supplier cancellation policies or other disclosed booking restrictions. 

  • Chargebacks resulting from Force Majeure Events or other circumstances beyond the reasonable control of The Katiya Experience or the applicable Supplier. 

  • Chargebacks based upon pricing, fees, taxes, or charges that were disclosed prior to booking. 

  • Chargebacks based solely upon your failure to review the booking confirmation, itinerary, supplier terms and conditions, or these Terms and Conditions. 


Nothing in this Section limits your right to dispute unauthorized, fraudulent, or otherwise unlawful charges as permitted by applicable law.

PRICE AND RATE CHANGES. The prices reflected in your proposal, itinerary, booking confirmation, Welcome Kit (if applicable), or on our website are based upon information available at the time they are prepared or published. Prices and availability are subject to change until your booking is confirmed and any required deposit or payment has been received.


Prices may include estimated taxes, fees, surcharges, or other governmental charges that are subject to change. At the time of booking confirmation, we will provide an invoice or payment authorization reflecting the then-current pricing and applicable inclusions.


We reserve the right to increase the price of your travel or Services before final payment if our costs increase due to changes imposed by Suppliers, taxes, governmental actions, currency fluctuations, fuel costs, airport charges, port fees, tariffs, or other circumstances beyond our reasonable control. If pricing changes before final payment, we will notify you and provide an updated invoice reflecting the revised pricing.


Unless otherwise provided in the applicable Supplier's terms and conditions or the Retreat Participation Agreement, once final payment has been received, your price is locked and will not increase.


We reserve the right to correct pricing errors, typographical errors, or inaccuracies at any time before your booking is confirmed. If a correction affects your booking, we will notify you and provide the opportunity to accept the corrected pricing before your booking is finalized.

CHANGES & CANCELLATIONS BY TRAVELER.

Changes by Traveler

Requests to modify an existing booking must be submitted in writing. Certain Suppliers treat changes as cancellations, and cancellation penalties or additional fees may apply. The Katiya Experience may also charge a change fee for certain Services. All requested changes remain subject to Supplier availability, Supplier approval, and the applicable Supplier's terms and conditions.


Cancellations by Traveler

Cancellation requests must be submitted in writing and will become effective on the business day we receive the request. Supplier cancellation policies govern most travel bookings and will apply in addition to these Terms and Conditions. The Katiya Experience may also charge a cancellation fee where disclosed prior to booking.


For retreats organized and hosted by The Katiya Experience, cancellations are governed exclusively by the applicable Retreat Participation Agreement.


Upon receiving your cancellation request, we will notify the applicable Supplier and request any refund or travel credit for which you may be eligible under the Supplier's policies. Any refund remains the sole responsibility of the applicable Supplier. Suppliers may elect to provide a travel voucher, future travel credit, or other alternative remedy instead of a monetary refund. The Katiya Experience is not responsible for a Supplier's failure to issue a refund, travel credit, or other compensation, including as a result of insolvency or bankruptcy.


If your reason for cancellation is covered under a travel protection plan, you may be eligible to recover certain cancellation costs through your insurer. For this reason, we strongly encourage the purchase of comprehensive travel protection, including cancel-for-any-reason coverage where available.


Air transportation is governed solely by the applicable airline's terms and conditions, and The Katiya Experience is not responsible for any airline's decision regarding refunds, credits, schedule changes, or cancellations. Cruise cancellation policies vary by cruise line and will be disclosed at the time of booking or in your booking confirmation. If you have questions regarding any Supplier's cancellation policy, please ask before completing your booking.

CHANGES AND CANCELLATIONS BY SUPPLIERS. We will notify you as soon as reasonably practicable if a Supplier makes a material change to or cancels your confirmed booking. We will use commercially reasonable efforts to assist in communicating with the applicable Supplier regarding any available alternatives, credits, refunds, or other accommodations offered by the Supplier; however, The Katiya Experience shall have no liability for any such changes, cancellations, or decisions made by the Supplier.


For retreats organized and hosted by The Katiya Experience, changes, postponements, substitutions, and cancellations are governed by the applicable Retreat Participation Agreement.


Between the time of booking and the completion of your travel, circumstances may require changes to your itinerary or travel arrangements. The Katiya Experience and its Suppliers reserve the right to modify itineraries or substitute comparable accommodations, transportation, activities, or other travel components when reasonably necessary due to transportation schedule changes, operational requirements, Supplier availability, safety concerns, weather conditions, governmental actions, Force Majeure Events, or other circumstances beyond our reasonable control.


During holidays, festivals, peak travel periods, religious observances, or other special events, certain museums, attractions, restaurants, tours, accommodations, shopping venues, or other facilities may have reduced hours, limited availability, or may be closed. Where reasonably practicable, comparable alternatives will be arranged; however, The Katiya Experience shall not be responsible for any closures, substitutions, itinerary modifications, or curtailments resulting from such circumstances. Unless otherwise required by applicable law, these changes shall not constitute a material change to your booking and shall not entitle you to cancel without otherwise applicable cancellation fees.

NO REFUND FOR UNUSED ARRANGEMENTS. Except as expressly provided in these Terms and Conditions, the applicable Supplier's terms and conditions, or the applicable Retreat Participation Agreement, there shall be no refund, credit, or reimbursement for any unused accommodations, transportation, meals, activities, excursions, or other travel arrangements.


If you voluntarily leave your trip early, elect not to participate in any portion of your travel, or otherwise fail to use any booked Travel Products or Services, no refund or credit will be provided unless expressly authorized by the applicable Supplier or otherwise required by applicable law.

FORCE MAJEURE. The Katiya Experience shall not be liable for any loss, damage, delay, cancellation, increased costs, or failure to perform resulting in whole or in part from a Force Majeure Event. A "Force Majeure Event" includes, without limitation, acts of God; natural disasters; fire; flood; earthquake; volcanic activity; severe weather; environmental contamination; power, utility, or technology failures; epidemics; pandemics; quarantine restrictions; war; terrorism; civil unrest; riots; labor disputes; governmental actions or travel advisories; border closures; airline schedule changes or cancellations; transportation interruptions; Supplier insolvency; hotel closures; or any other event beyond the reasonable control of The Katiya Experience or the applicable Supplier.


If a Force Majeure Event affects your travel, The Katiya Experience will use commercially reasonable efforts to assist you in working with the applicable Supplier regarding any available refunds, credits, rescheduling options, or alternative arrangements. Any refund, credit, or alternative remedy shall remain subject to the Supplier's policies and the terms of any applicable Retreat Participation Agreement.


Unless otherwise required by applicable law, The Katiya Experience shall have no obligation to provide refunds for losses resulting from a Force Majeure Event. If we recover any refundable amounts from a Supplier on your behalf, we will remit those amounts to you without additional service charges.

TRAVEL PROTECTION INSURANCE. Protecting your travel investment is your responsibility. Accordingly, The Katiya Experience strongly recommends that every traveler purchase comprehensive travel protection, including, where available, Cancel for Any Reason (CFAR) coverage or comparable protection.


An appropriate travel protection plan should include, as applicable, coverage for trip cancellation, trip interruption, emergency medical expenses, emergency medical evacuation and repatriation, baggage loss or delay, travel delays, and other travel-related risks. Travel protection should be purchased as soon as possible after making your travel arrangements to maximize available coverage.


For retreats organized and hosted by The Katiya Experience, travel insurance may be required as a condition of participation pursuant to the applicable Retreat Participation Agreement.


The Katiya Experience is not licensed to advise you regarding the terms, benefits, exclusions, or adequacy of any travel insurance policy and makes no representation that any particular policy is suitable for your needs. Questions regarding coverage should be directed to your insurance carrier, broker, or licensed insurance professional.


Certain destinations require proof of medical or travel insurance as a condition of entry. It is solely your responsibility to determine and satisfy all entry requirements for your destination. The Katiya Experience shall not be responsible for denied boarding, denied entry, additional expenses, or any losses resulting from your failure to obtain the required insurance or documentation.


If you elect to travel without adequate travel protection, you acknowledge that you assume the risk of any resulting losses, including non-refundable travel costs, medical expenses, emergency transportation costs, and other unforeseen expenses. To the fullest extent permitted by applicable law, The Katiya Experience shall not be liable for any such losses.

DESTINATIONS AND DOCUMENTATION. Travel to certain destinations may involve greater risk than others. The Katiya Experience urges travelers to remain informed on a daily basis as to current news, as well as to review travel prohibitions, warnings, announcements, and advisories issued by the United States Government prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at http://www.state.gov, and http://www.cdc.gov. In addition, you should consult with government websites to ensure that you are in compliance with all requirements for admittance into that country, including COVID- 19 requirements, as well as understanding local laws that govern travel within a country, such as medical tests and tracking. It is your responsibility to be aware of any and all requirements for admittance to a country or state. Should you choose to travel to a country that has been issued a travel warning or advisory, The Katiya Experience will not be liable for damages or losses that result from travel to such destinations. 


It is the responsibility of each traveler to obtain and carry a valid passport, visa(s), inoculations, and all other documents required by applicable government regulations. For up-to-date requirements US citizens should visit www.travel.state.gov. When travelling domestically within the USA or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification in order to board a flight, found here:
http://www.tsa.gov/traveler-information/acceptable-ids. Air travelers with identification that does not meet the REAL ID Act requirements will have to use alternative forms of ID (passport, military ID, or permanent resident card) to pass through TSA security check-points- even for domestic travel. Visas are required when they apply. You can find out if your international destination requires a visa at: https://www.usa.gov/visas-citizens-traveling-abroad. Travelers voluntarily assume full and sole responsibility for any and all risks and/or costs involved with failure to report errors and/or omissions to documentation. The Katiya Experience strongly recommends that you take into account that certain countries will not admit a passenger if their passport expires within six (6) months of the date of entry. Non-USA citizens may require additional documentation. Children and infants also require all such travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted, unless authenticated and verified consent forms are provided to the authorities. Please visit www.travel.state.gov or https://www.dhs.gov/real-id for the most updated requirements for travel documentation. 


Certain countries restrict travelers with criminal convictions, even if expunged. Please inform us prior to booking with us if this applies to you and seek separate legal counsel to confirm your ability to travel to your desired destination. If you are denied access to a country or a Supplier due to a conviction or criminal record, The Katiya Experience shall not be liable for any losses, expenses, or refunds to you, or anyone in your group.


Recommended inoculations for travel may change and you should consult your practitioner for current recommendations before you depart. It is your responsibility to ensure that you meet all health entry requirements, obtain the recommended inoculations, take all recommended medication, and follow all medical advice in relation to your travel. Inoculation requirements can be found on the Center for Disease Control website at
https://www.cdc.gov/


You acknowledge any failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing traveler to miss flight(s), and subsequent scheduled travel bookings.  The Katiya Experience bears no responsibility for advising and/or obtaining required travel documentation for you, or for any delays, damages, and/or losses including missed portions of your travel plans related to improper documentation or government decisions about entry.

INSECTICIDE NOTICE.  Travelers are encouraged to check the list of countries that require airlines to treat the passenger cabin with insecticides prior to the flight or while on the aircraft on the U.S. Department of Transportation’s Web site, as this list is updated from time to time: http://www.dot.gov/office-policy/aviation-policy/aircraft-disinsection-requirements.

HAZARDOUS MATERIALS. Federal law forbids the carriage of hazardous materials aboard aircraft in your luggage or on your person. A violation can result in five years’ imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives, and radioactive materials. Examples include Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radioactive materials. There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in your luggage and certain smoking materials carried on your person. NON-RESPONSIBILITY. Except with respect to retreats organized and hosted directly by The Katiya Experience, The Katiya Experience, its owners, members, managers, employees, contractors, affiliates, agents, and representatives (collectively, the "Representatives") utilize independent third-party suppliers to arrange and provide transportation, accommodations, tours, excursions, sightseeing, restaurants, and other travel-related services (collectively, the "Suppliers").


For retreats organized and hosted by The Katiya Experience, we act solely as the organizer and coordinator of the retreat experience. However, the accommodations, transportation, excursions, activities, restaurants, and other travel-related services associated with the retreat are provided by independent Suppliers operating under their own terms and conditions.


Except as expressly stated above, The Katiya Experience does not own, operate, manage, supervise, or control any airline, cruise line, hotel, resort, transportation provider, tour operator, destination management company, restaurant, activity provider, or other Supplier. All Suppliers are independent contractors and are not employees, agents, joint venturers, or representatives of The Katiya Experience.


All tickets, confirmations, itineraries, vouchers, reservations, and travel documents are issued subject to the applicable Supplier's terms and conditions. By booking travel through The Katiya Experience, you acknowledge and agree that neither The Katiya Experience nor its Representatives shall be liable for any act, error, omission, delay, cancellation, injury, illness, death, loss, accident, property damage, property loss, inconvenience, overbooking, insolvency, bankruptcy, strike, labor dispute, governmental action, Force Majeure Event, or any other occurrence arising from or attributable to any Supplier or otherwise beyond our reasonable control.


The Katiya Experience assumes no responsibility for lost, stolen, or damaged personal property or belongings during your travel. We also make no representations regarding the conduct, demographics, behavior, compatibility, or actions of other travelers, guests, or participants you may encounter during your travel or during any retreat.


We reserve the right, in our sole discretion and to the fullest extent permitted by applicable law, to decline or terminate Services, cancel a booking, or discontinue our relationship with any traveler at any time upon written notice where we determine it is appropriate to do so.

ASSUMPTION OF RISK; RELEASE OF LIABILITY. Travel inherently involves known and unknown risks, many of which are beyond the reasonable control of The Katiya Experience. These risks may include, without limitation: transportation accidents; motor vehicle collisions; airline delays or cancellations; slips, trips, and falls; drowning; exposure to wildlife, insects, reptiles, or other animals; criminal acts; terrorism; civil unrest; governmental actions; foodborne illness; consumption of alcohol; unsafe food or water; communicable diseases; weather conditions; natural disasters; physical exertion; recreational activities; theme park attractions; remote locations with limited medical facilities; delays in obtaining medical care; and the acts or omissions of Suppliers, other travelers, guides, or other third parties.


You acknowledge that this list is not exhaustive and that additional known or unknown risks may exist. By using our Services or participating in any travel arranged through The Katiya Experience, you voluntarily assume all risks associated with your travel, whether known or unknown, foreseeable or unforeseeable.


TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU, ON BEHALF OF YOURSELF AND YOUR HEIRS, PERSONAL REPRESENTATIVES, SUCCESSORS, AND ASSIGNS, HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE THE KATIYA EXPERIENCE OR ITS REPRESENTATIVES FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, LOSSES, COSTS, OR EXPENSES ARISING OUT OF OR RELATING TO YOUR TRAVEL, THE SERVICES PROVIDED BY THE KATIYA EXPERIENCE, OR THE ACTS OR OMISSIONS OF ANY SUPPLIER, INCLUDING CLAIMS ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EXCEPT TO THE EXTENT A CLAIM IS FINALLY DETERMINED BY A COURT OF COMPETENT JURISDICTION TO HAVE RESULTED SOLELY FROM THE GROSS NEGLIGENCE OR WILLFUL MISCONDUCT OF THE KATIYA EXPERIENCE WHERE SUCH LIMITATION IS PROHIBITED BY APPLICABLE LAW.


THIS RELEASE APPLIES TO ALL CLAIMS ARISING BEFORE, DURING, OR AFTER YOUR TRAVEL AND INCLUDES CLAIMS RELATING TO PERSONAL INJURY, ILLNESS, DEATH, PROPERTY DAMAGE, PROPERTY LOSS, TRAVEL DELAYS, SUPPLIER FAILURES, OR OTHER TRAVEL-RELATED INCIDENTS.


This release and assumption of risk are intended to be as broad and inclusive as permitted by applicable law and shall survive the completion, cancellation, or termination of your travel, booking, or use of our Services.

INDEMNIFICATION. You agree to defend, indemnify, and hold harmless The Katiya Experience and its owners, members, managers, employees, contractors, affiliates, agents, representatives, successors, and assigns (collectively, the "Representatives") from and against any and all claims, demands, actions, liabilities, damages, judgments, settlements, losses, costs, and expenses (including reasonable attorneys' fees and costs) arising out of or relating to: (a) your breach of these Terms and Conditions or any other agreement with The Katiya Experience; (b) your negligent, reckless, unlawful, or intentional acts or omissions; (c) your violation of any applicable law or the rights of any third party; (d) any damage to property or injury to any person caused by you or anyone traveling under your booking; or (e) any claim brought by a third party arising from your conduct or participation in any travel arranged through The Katiya Experience.


This Section shall survive the completion, cancellation, or termination of your travel or use of our Services.

YOUR BEHAVIOR. You and all individuals traveling under your booking are expected to conduct yourselves in a respectful, lawful, and responsible manner and to comply with all rules, policies, and behavioral requirements established by The Katiya Experience and any applicable Supplier.


Suppliers reserve the right to refuse service to, deny boarding to, remove, or otherwise exclude any traveler whose conduct, health, intoxication, or behavior is determined to endanger themselves or others, interfere with the operation or enjoyment of any travel service, violate applicable laws or Supplier policies, or otherwise be disruptive. For retreats organized and hosted by The Katiya Experience, participant conduct is also governed by the applicable Retreat Participation Agreement.


If you or anyone traveling under your booking is removed from any portion of your travel or retreat for any of the foregoing reasons, no refund, credit, or reimbursement shall be owed unless expressly required by applicable law or the applicable Supplier.


You accept responsibility for any loss, damage, injury, or expense caused by you or anyone traveling under your booking. You agree to pay all resulting charges and to indemnify The Katiya Experience for any claims, damages, liabilities, or expenses (including reasonable attorneys' fees) arising from such conduct.


The Katiya Experience shall not be responsible for any costs, losses, or expenses incurred by any traveler who is denied service or removed from any portion of a trip or retreat as a result of their conduct.


Baggage and personal belongings remain the sole responsibility of each traveler at all times.

BAGGAGE FEES. Airline baggage allowances, baggage fees, carry-on restrictions, seat assignment fees, and other ancillary charges are established solely by the applicable airline and are subject to change without notice. Travelers are responsible for reviewing the applicable airline's policies before departure.


The Katiya Experience is not responsible for baggage fees, seat selection fees, overweight baggage charges, or any other fees imposed by an airline or other Supplier.

RECONFIRM YOUR FLIGHT. We strongly recommend that you reconfirm your flight schedule directly with your airline at least twenty-four (24) hours before departure to verify departure times, gate information, schedule changes, and any other travel updates. Most airlines also permit online check-in beginning approximately twenty-four (24) hours prior to departure. The Katiya Experience is not responsible for schedule changes, delays, cancellations, or missed flights resulting from your failure to confirm your flight information directly with the airline.

HEALTH; MEDICAL CONDITIONS; ACCESSIBILITY. If you have a disability, medical condition, allergy, dietary restriction, limited mobility, pregnancy, or any other circumstance that may affect your travel or require special accommodations, you should notify us before booking so that we may communicate your requests to the applicable Supplier and assist you in determining whether the travel arrangements are appropriate for your needs.


The Katiya Experience will make reasonable efforts to communicate accommodation requests to the applicable Suppliers but cannot guarantee that any requested accommodation will be available. Accommodation standards vary by destination, and accessibility requirements outside the United States may differ significantly from those required under the Americans with Disabilities Act ("ADA"). Any costs associated with requested accommodations shall remain your responsibility unless otherwise agreed by the applicable Supplier.


Some Suppliers may require travelers with limited mobility or certain medical conditions to travel with a companion capable of providing necessary assistance. Certain Suppliers may also require medical documentation confirming your fitness to travel. Compliance with such requirements is solely your responsibility.


If you are pregnant or expect to be pregnant during your travel, please notify us before booking. Certain Suppliers restrict travel after specified stages of pregnancy and may deny boarding, embarkation, or participation based upon their policies. You are responsible for consulting your healthcare provider regarding your fitness to travel and reviewing all applicable Supplier requirements before departure.


The Katiya Experience shall not be liable for denied boarding, denied embarkation, denied entry, or any resulting losses, expenses, or damages arising from a traveler's medical condition, disability, pregnancy, failure to satisfy Supplier requirements, or inability to obtain requested accommodations.

PHOTOGRAPHIC & VIDEO LIKENESS; FEEDBACK. Traveler acknowledges and agrees that photographs, videos, audio recordings, and other media may be captured during travel, retreats, or other Services by The Katiya Experience or by photographers, videographers, or other independent contractors engaged by The Katiya Experience.


Traveler hereby grants The Katiya Experience, its affiliates, successors, assigns, licensees, and designees a perpetual, worldwide, royalty-free, fully paid-up, transferable, sublicensable, and irrevocable right and license to photograph, record, reproduce, edit, publish, distribute, display, perform, transmit, and otherwise use Traveler's name, image, likeness, voice, appearance, biographical information, and any statements made during travel or in connection with the Services in any media now known or later developed, including websites, social media platforms, advertisements, promotional materials, marketing campaigns, and other commercial or non-commercial purposes, without further notice, approval, or compensation.


Traveler acknowledges that The Katiya Experience shall own all right, title, and interest in any photographs, videos, recordings, or other media created by or on behalf of The Katiya Experience.


Traveler waives any right to inspect or approve the final use of such materials and releases The Katiya Experience and its Representatives from any claims arising from the authorized use of Traveler's name, likeness, image, voice, or appearance as permitted under these Terms and Conditions.

CLASS ACTION WAIVER; LIMITATION OF DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS AND CONDITIONS, YOUR USE OF OUR WEBSITE OR SERVICES, OR ANY BOOKING MADE THROUGH THE KATIYA EXPERIENCE SHALL BE BROUGHT SOLELY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION, COLLECTIVE ACTION, REPRESENTATIVE ACTION, OR OTHER SIMILAR PROCEEDING.


TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE KATIYA EXPERIENCE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES. ANY RECOVERY SHALL BE LIMITED TO THE GREATER OF (A) THE AMOUNT OF COMMISSIONS, FEES, OR OTHER COMPENSATION ACTUALLY RECEIVED BY THE KATIYA EXPERIENCE IN CONNECTION WITH YOUR BOOKING, OR (B) THE AMOUNT YOU ACTUALLY PAID DIRECTLY TO THE KATIYA EXPERIENCE FOR THE APPLICABLE SERVICES.

WAIVER OF JURY TRIAL; NOTICE OF CLAIM. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU KNOWINGLY, VOLUNTARILY, AND IRREVOCABLY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS AND CONDITIONS, YOUR USE OF OUR WEBSITE OR SERVICES, OR ANY BOOKING MADE THROUGH THE KATIYA EXPERIENCE.


Before commencing any legal action against The Katiya Experience, you agree to provide written notice of your claim by email to katiya@thekatiyacollective.com. Such notice must describe the nature of the dispute and the relief requested and must be provided within thirty (30) days after you knew or reasonably should have known of the events giving rise to the claim.


The Parties agree to use commercially reasonable efforts to resolve the dispute informally before commencing litigation.

GOVERNING LAW; VENUE. These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.


The Parties agree that any action or proceeding arising out of or relating to these Terms and Conditions, your use of our website or Services, or any booking made through The Katiya Experience shall be brought exclusively in the state or federal courts located in Broward County, Florida. Each Party irrevocably submits to the jurisdiction of such courts and waives any objection based upon improper venue or forum non conveniens.

ELECTRONIC COMMUNICATIONS. The Katiya Experience communicates primarily through email, telephone, text message, and other electronic means. By providing your contact information and using our website or Services, you consent to receive electronic communications relating to your inquiries, bookings, travel arrangements, itineraries, Welcome Kits (where applicable), invoices, notices, updates, marketing communications (where permitted by law), and other information relating to our Services.


You agree that all agreements, notices, disclosures, invoices, authorizations, confirmations, and other communications provided electronically satisfy any legal requirement that such communications be in writing.

ENTIRE AGREEMENT; SEVERABILITY. These Terms and Conditions, together with any applicable booking confirmation, Welcome Kit, Retreat Participation Agreement, itinerary, invoice, Supplier terms and conditions, Privacy Policy, and any other documents expressly incorporated by reference, constitute the entire agreement between you and The Katiya Experience with respect to the applicable Services and supersede all prior or contemporaneous communications, negotiations, representations, and agreements, whether oral, written, or electronic.


If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permitted by applicable law, and the remaining provisions shall remain in full force and effect.


No failure or delay by The Katiya Experience in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that right or remedy.


Any provision that by its nature should survive termination, cancellation, or completion of the Services, including, without limitation, payment obligations, intellectual property, confidentiality, assumption of risk, releases, limitations of liability, indemnification, dispute resolution, governing law, venue, and all other provisions intended to survive, shall remain in full force and effect.


These Terms and Conditions are written in the English language. Any translation is provided solely for convenience. In the event of any inconsistency between the English version and any translated version, the English version shall control.
