The Katiya Experience Terms and Conditions
These Terms and Conditions ("Agreement") are entered into by and between The Katiya Experience ("Company," "we," or "us") and the Client ("you" or "Client"). By engaging our services, you agree to the terms outlined below.
Description of Services
The Katiya Experience provides customized travel planning services, including but not limited to:
Personalized itinerary creation.
Group travel coordination.
Curated experiences tailored to client preferences.
All services are subject to availability and will be agreed upon before the commencement of work. Additional services, if applicable, will be detailed and agreed upon in writing.
Modifications to Itineraries
While The Katiya Experience strives to adhere to planned itineraries, unforeseen circumstances (e.g., natural disasters, and supplier cancellations) may necessitate changes. We will communicate these changes promptly and offer alternatives where possible.
Role as Agent and Advisor
By engaging in The Katiya Experience, you acknowledge that:
As a Travel Agent, we have a fiduciary duty to suppliers and act as an intermediary between you and the travel providers (e.g., airlines, hotels, tour operators).
As a Travel Advisor, we have a duty of care to our clients and work to provide expert guidance and personalized travel planning services.
Booking and Payment Terms
Service Fees: Our service fees are disclosed upfront during the consultation process.
Payment Schedule: Payments must be made according to the agreed schedule outlined in the booking confirmation. Failure to adhere to payment deadlines may result in cancellation.
Credit Card Authorization: By providing your credit card information for travel bookings, you authorize The Katiya Experience and its third-party suppliers to charge your card for agreed-upon travel services, including applicable deposits, fees, and final payments. You agree that chargebacks or disputes must first be addressed with The Katiya Experience.
Chargebacks and Payment Disputes: By authorizing payment for travel services, the Client agrees not to initiate a chargeback with their credit card company for any legitimate charges associated with their travel arrangements. If a dispute arises regarding a charge, the Client agrees to first attempt resolution directly with The Katiya Experience. Unjustified chargebacks will be considered a breach of this Agreement and may result in legal action or additional fees to cover costs incurred.
Refund and Cancellation Policy
Planning Fees: All planning fees are non-refundable once services have commenced.
Travel Bookings: Refunds for travel bookings, if any, are subject to the policies of the suppliers (e.g., airlines, hotels, tour operators) and are not determined by The Katiya Experience.
Client-Initiated Cancellations: If you choose to cancel your trip, cancellation fees may apply as per the supplier’s terms. These fees will be communicated to you during the booking process.
Company-Initiated Cancellations: In the unlikely event that The Katiya Experience must cancel services, any refundable amounts will be promptly returned to the Client by the supplier, excluding non-refundable fees already paid to suppliers.
Cancellation requests must be submitted in writing. Refunds do not include non-recoverable costs incurred by third-party suppliers.
Florida Seller of Travel Registration
The Katiya Experience complies with Florida’s Seller of Travel Act. We are registered annually with the Florida Department of Agriculture and Consumer Services (Seller of Travel Registration No. ST43973) and maintain Errors and Omissions Insurance.

Consumer Disclosures
In compliance with federal regulations, we provide the following mandatory disclosures:
Code-Sharing Agreements: If a flight is operated by a carrier other than the one listed on your ticket, we will inform you in advance.
Baggage Fees: Additional fees for checked or carry-on luggage will be disclosed during the booking process by the carrier.
Hazardous Materials Restrictions: Clients will be informed of prohibited items, such as flammable materials, in checked or carry-on luggage.
Insecticide Use: The carrier will notify you if your destination requires insecticide spraying inside aircraft cabins.
Transportation of illegal drugs is not permitted.

Data Privacy and Security
The Katiya Experience is committed to protecting your personal information. Data collected during the travel planning process will be used exclusively for service delivery. Key principles include:
Data Collection: We collect personal information such as name, contact details, and travel preferences.
Data Usage: Your data is used solely for travel planning purposes and is shared only with relevant third-party suppliers.
Data Protection: We implement industry-standard security measures to protect your data.
Your Rights: You may request access to your data or ask for it to be deleted at any time by contacting us.

Anti-Discrimination Policy
The Katiya Experience provides equal service to all clients regardless of race, color, religion, sex, national origin, age, disability, sexual orientation, gender identity, or genetic information. The Katiya Experience strives to create an inclusive and welcoming environment.
Client Responsibilities
Clients are responsible for:
Providing accurate information to facilitate travel planning.
Reviewing and approving proposed itineraries within specified timeframes.
Securing necessary travel documents, including passports and visas, and bringing these documents on their trip.
Ensuring adherence to entry requirements, such as vaccinations or testing protocols.
Researching the safety of the destination they want to travel to.
Limitation of Liability
The Katiya Experience is not liable for:
Acts or omissions of third-party suppliers that cause damages, injury, or loss.
Delays, cancellations, or changes in travel arrangements due to circumstances beyond our control.
Accidents, Unsafe Conditions, Policies, Theft of personal belongings, or bankruptcies and defaults.
Dispute Resolution
Any disputes arising from this Agreement will be resolved through arbitration in accordance with Florida law. The arbitrator's decision will be final and binding.
Limitation on Damages
The client agrees that because The Katiya Experience is an agent paid on commission and fees, The Katiya Experience is not liable for anything more than the value of these commissions and fees.
Marketing Consent
By accepting the Terms and Conditions, you consent to The Katiya Experience using testimonials, reviews, and/or photos from your trip for marketing purposes. This may include, but is not limited to, social media posts, website features, and promotional materials. If you do not consent, please indicate this in writing.
Updates to Terms and Conditions
The Katiya Experience reserves the right to modify these Terms and Conditions at any time to reflect changes in laws or business practices. Significant updates will be communicated via email or through our website.
Client Acknowledgment
By engaging in The Katiya Experience services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. You hereby represent and warrant that you are authorized to accept on behalf of all members of your traveling party, and you agree to indemnify, hold harmless and defend us against all claims by said members arising out of or related to any matter covered by these terms and conditions.
Complete Agreement Clause: Nothing that I or my subagents, employees, or independent contractors say to clients undercuts or undermines these terms and conditions.
